Application To Declare A Felony a Misdemeanor

 

 

 

Q U A L I F I C A T I O N S

1.. Must have been arrested for a wobbler crime.  There are over a hundred cases that can be classified as either a felony or a misdemeanor.    These types of cases are referred to as a wobbler due to the sentencing structure.    In other words, a crime that could have sentenced you to either State Prison, County Jail, or by just a fine.

2.. You must have been 18 or older when you were arrested

3.. You received probation as part of your sentence.  If you did not receive probation press   No Probation

4..Your probation must be completed in and all the conditions of your sentence fulfilled.

If your case is not classified as a wobbler at the time of arrest then you can not use this remedy.   

For non wobbler felon cases you can apply for a Certificate of Rehabilitation

 You will probably have to hire an attorney

 

 

B E N E F I T S

You will no longer be classified as an ex-felon.    We all know it is better to have a misdemeanor in your file than a felony

You will not have to tell your employer that you were arrested for a felony and if anyone asks you may say that you have not had any felony convictions.    If asked,  you must advise that you were arrested for a misdemeanor.

The court will notify the Department of Justice & arresting agency to change their records to reflex that this case is now a misdemeanor.   You should check  six months after your case has been reduced,  to see that everyone has been notified.   Send a copy of your court order, showing the reduction to a misdemeanor, to all agencies concerned.
