Application to withdraw conviction, to dismiss the case &
for relief from all penalties & disabilities related to this case

1..You must have been convicted of a misdemeanor with no probation.  If you were placed on probation then press here

2.. You had to have been 18 or over  when the crime occurred.   If you were not an adult at the time the crime occurred then try a different remedy from the Juvenile Section.

3.. You may not use this remedy if you were arrested for an infraction, a felony, or a Vehicle Code violation of 2800,  2801,  & 2803

4.. Your case must have been tried  in adult court    If your case was tried in a juvenile court then you should try different remedy from the  Juvenile Section.

5..Your case can not be for failing to obey a traffic officer or for failing to stop to submit to an inspection.

6.. If you were convicted for possession of marijuana then do not use this remedy,   press here

7..You can not be serving a sentence for any other crime

8..You must be living an honest life and obeying all laws

9..You must wait at least one year after you were sentenced.

10.You have to have complied with all the provisions of your sentence.

11.You can not be in a criminal trial or have a criminal trial pending.

Your guilty plea will be withdrawn and a plea of not guilty will be entered into your file.

You will no longer be required to disclose this charge to anyone including employers.

You may apply for driver and professional licenses.

You will not have to report this criminal offense to immigration.  This sealing remedy will not help you on moral turpitude cases.

You will gain the right to possess a legal weapon.
